Cycle Hire Terms and Conditions

1. General Information and Agreement

1.1 We aim to provide high-quality e-cargo bikes for hire. To achieve this at a reasonable cost, we ask our customers to treat the equipment responsibly.

1.2 Bikes and equipment can only be hired from Bike for Good by accepting our hire conditions on our online booking portal. Bike for Good reserves the right to take a deposit to hold as security until the bike is returned in the condition it was hired out in. Upon acceptance of these Terms & Conditions, a binding contract is formed between Bike for Good and the hirer. We reserve the right not to accept or fulfill a Booking.

1.3 All Bookings are subject to availability.

1.4 The Hire period commences on the day the cycle(s) and equipment are collected by you and continues until the cycle(s) and equipment are returned to Bike for Good.

2. Hirer’s Terms and Conditions

2.1 You must be at least 18 years of age to hire or ride a cargo bike from Bike for Good.

2.2 Documents Required:

Proof of Address: We require proof of your current address such as a bank statement or utility bill from within the last 3 months. For multi-day hires, this address must be where the e-cargo bike will be stored overnight during the hire period.

ID document: You must provide a valid passport or driving license as proof of identification.

We will take scans of both of these documents when you collect the cargo bike; these scans will be deleted upon the safe return of the cargo bike and any included accessories, or the settlement of payment if there has been damage to the cargo bike or accessories during your hire.

2.3 You agree that you are a competent, confident, and considerate cyclist: it is important that your own personal riding skills are to the National Standard for Cycling as defined by Cycling Scotland.

2.4 You are responsible for ensuring that you are capable of using Bike for Good Cycle(s) or Equipment you have booked. Bike for Good does not accept any responsibility for your failure to complete your Hire period due to lack of fitness, illness, or injury. Bike for Good does not accept liability for death, personal injury, loss, or damage to personal effects to any participant, nor can Bike for Good accept any responsibility for delays or changes to your period of Hire due to weather, strikes, war, terrorism, or other causes.

2.5 You accept that cycling on a public highway carries its own risks, and you have made your booking on the basis that you undertake the Hire at your own risk. You understand and accept that Bike for Good insists on wearing cycle helmets at all times when riding.

2.6 You will ride your cycle responsibly at all times. You will not hold Bike for Good responsible for any loss, damage, or injury including death to persons or property with regard to the use of the cycle(s) and equipment hired. You accept responsibility to indemnify Bike for Good against any claim, interest, demand, or expense in respect of such injury or damage.

2.7 Bike for Good recommends that you have suitable insurance cover at all times during the period of your hire.

2.8 You are responsible for all cycles and equipment hired or loaned, and it is your responsibility to keep these items safe from damage, loss, or theft, use them properly, and not subject them to any misuse or unfair wear and tear.

2.8.1 You will be responsible for paying Bike for Good the reasonable costs of repair or replacement for any:

(a) Damage or loss caused by you or any third party to the cargo bike or included accessories during the duration of the hire.

(b) Theft whilst the cargo bike is hired to you, unless it is securely locked to a permanent structure by means of a Sold Secure approved bicycle lock; we will provide a Sold Secure approved bicycle lock for the duration of the hire. The lock must go through the frame of the cargo bike and be attached to a permanent structure to be considered securely locked.

2.9 You will notify Bike for Good immediately of any loss, damage, or theft to the hired cycles or equipment however caused.

2.10 You will not offer for sale, sell, dispose, mortgage, lend, pledge, or otherwise part with possession of the hired cycle(s) or equipment.

2.11 Cycle(s) are safety-checked and any issues remedied prior to each hire; however, it is the customer’s responsibility to keep the bike they have hired in a safe and road-worthy condition. Whilst Bike for Good will always do its best to have staff available during the hire period to assist with any issues that may arise with the hired cycle(s) or equipment, this cannot be guaranteed.

2.12 All hires are to be collected from, and returned to; Bike for Good West, 65 Haugh Road, Glasgow, G3 8TX, between the hours of 9.00am and 4.30pm Tuesday to Saturday.

2.13 We do not offer delivery or uplift of hired cargo bikes.

2.14 The use of the cargo bike for hire and reward work (e.g. food delivery work, courier work) is strictly forbidden.

2.15 Consecutive bookings are not allowed; if you want to hire a cargo bike for longer than our maximum time (5 days) please contact activetravel@bikeforgood.org.uk to discuss your requirements.

2.16 You agree to fill out a baseline form with your details, which we keep in order to comply with our obligations to our insurers. Your information will remain confidential within our system and in compliance with our GDPR policies (see 7.5).

3. Payment Terms

3.1 Payments are collected on booking the bike. In the event of you cancelling your booking, we will charge a percentage of the hire price to cover our administration costs and the costs of lost business. Our cancellation policy is as follows:

Up to 2 weeks before the event or hire date – 20% of the hire price.

Up to 3 days before the event or hire date – 50% of the hire price.

1 day before the event – 75% of the hire price.

Day of hire – Full hire price will be charged.

Bike for Good will consider individual cases in extraordinary circumstances.

3.2 In consideration of our arranging and fulfilling your Hire in accordance with these terms and conditions, you will pay Bike for Good the total price for your period of Hire set out in the Hire Agreement Form in advance of the hire commencing.

3.3 Late return of the Cycle(s) and accessories will be charged an additional day’s hire fee, at the 1-day hire rate starting rate, not at any of the lower consecutive multi-day rates.

3.4 A Credit Card will be required at the commencement of any hire period. A deposit of £250 is taken from the Customer as standard upon the hire of an e-cargo bike from Bike for Good’s SWITCHUP library, usually in the form of a credit card pre-authorisation, or otherwise by a cash deposit for the duration of the hire. This may extend to a deposit to the value of the cycle(s) by credit or debit card payment or other surety as deemed sufficient by Bike for Good depending on Bike for Good’s assessment of the risk and the value of the equipment. Any deposit taken will be returned at the end of the hire period provided that:

Any cycles and/or equipment hired or used are returned in an undamaged condition to Bike for Good.

Any cycles and/or equipment hired or used are returned within the arranged hire period at an arranged time and place to Bike for Good.

3.5 If the terms set out in 3.4 (above) are not complied with, Bike for Good reserves the right to charge reasonable charges until such time when cycles and/or equipment concerned have been returned to Bike for Good. In the case of cycles and/or equipment left or returned damaged, you are responsible for any costs incurred and sustained in replacing or repairing (whichever is cheaper) the items concerned to a condition equivalent to that prior to the Hire.

3.6 In all cases, normal wear and tear as defined by the product’s manufacturer or supplier is accepted and allowed and is included in any hire price.

3.7 In all cases, the security/damage deposit can be used as a deposit against the costs or charges mentioned herein.

4. Refunds/Reschedule

4.1 You can reschedule your booking once, up to 7 days before your hire date free of charge. Reschedules within 4-7 days of your hire will incur a £25 admin fee. Reschedules within 3 days of the hire are not permitted (please refer to our cancellation policy above in point (3.1)).

5. Personal Safety

5.1 It is the rider’s responsibility for their own safety. Cycling involves personal risk, and you must ride responsibly.

5.2 Injuries and/or death associated with the sport of cycling may result from weather, excessive speed, collision with inanimate objects or other persons, rider inexperience, error, or abuse of equipment.

5.3 We will go over the use of the cargo bike, and any special features it has, with you when you collect the cargo bike from us at the beginning of the hire. We strongly encourage you to familiarise yourself with cargo bike, and the differences in how it rides from an ordinary bicycle, before riding it laden with any cargo, particularly with children also on the cargo bike

5.4 With regard to point (5.3) above, you agree to ride the cargo bike in accordance with the manufacturer’s instructions, and with the manufacturer of any accessories’ instructions (e.g. child seats). You agree to ride any cargo bike hired from Bike for Good with children only in accordance with the manufacturer’s intended use of the cargo bike, using any provided safety features or equipment at all times

5.4 You must not cycle under the influence of alcohol, strong medication, other drugs, or fatigue.

6. Our Liability to You

6.1 Bike for Good accepts responsibility for death, personal injury, and direct loss suffered by you, which can be demonstrated was caused by our negligence up to the limit set out in clause 7.3 below.

6.2 Bike for Good will not be liable to you where any alleged loss or damage results from:

Any of your own actions or omissions;

The action or omission of a third party not connected with the provision of your bike hire;

An event or circumstance which we could not have predicted or avoided even after taking all reasonable care;

Where any loss or damage is considered to be indirect or consequential loss.

6.3 Except in respect of death and personal injury, in respect of which no limit of liability shall apply, Bike for Good’s total liability to you under this contract between us shall be limited to the total cost of your Booking.

6.4 Bike for Good shall have no liability to you if we are unable to fulfill a Booking due to an event of Force Majeure. In the event of Bike for Good being unable to fulfill your booking, our liability to you shall not exceed the agreed cost of the hire.

6.5 Except where expressly permitted under the Data Protection Act 1998, we will only use your personal details in connection with your Booking arrangements, unless you agree otherwise. We will keep your personal details secure in accordance with our obligations under the Data Protection Act 1998.

7. General

7.1 These terms and conditions constitute the entire agreement between us and supersede any previous agreement or understanding and may not be varied except in writing between us. All other terms, express or implied by statute or otherwise, are excluded to the fullest extent permitted by law.

7.2 Any notice required or permitted to be given by either of us to the other under these terms and conditions shall be in writing.

7.3 No failure or delay by either of us in exercising any of its rights under these terms and conditions shall be deemed to be a waiver of that right, and no waiver by either of us of any breach of these terms and conditions by the other shall be considered as a waiver of any subsequent breach of the same or any other provision.

7.4 If any provision of these terms and conditions is held by any court or other competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these terms and conditions and the remainder of the provision in question shall not be affected.

7.5 Except as otherwise expressly provided herein, nothing in these terms and conditions confers or purports to confer on any third party any benefit or any right to enforce any of these terms or conditions pursuant to the Contracts (Rights of Third Parties) Act 1999.

7.6 These terms and conditions shall be governed by Scots law, and both of us hereby agree to submit to the exclusive jurisdiction of the Scots Courts.
